Terms and Conditions

The agreement between you and us when you use eRideList — what we do, what we do not do, and what we expect from buyers, sellers, renters and service providers.

1. Introduction

Welcome to eRideList. The Platform is operated by Kok Kiong Lau trading as eRideList (ABN 14 218 299 030) ("we", "us", "our"). These Terms and Conditions ("Terms") govern your use of our website and services (together, the "Platform"), which advertises e-rides, electric vehicles (EVs), hybrid EVs and related services for users in Australia.

By accessing or using the Platform you agree to these Terms, to our Privacy Policy and to our Cookie Policy. If you do not agree, please do not use the Platform. Nothing in these Terms limits your rights under Australian law, including the Australian Consumer Law (ACL) and the Privacy Act 1988 (Cth).

2. Definitions

  • Platform — the eRideList website and the features we provide through it.
  • User — any person or entity using the Platform, including buyers, sellers, renters, service providers and visitors.
  • Owner — a User listing an acceptable item for sale or rent.
  • Buyer / Renter — a User buying or renting an acceptable item.
  • Service Provider — a User offering Services.
  • e-rides — personal mobility devices powered by an electric battery and designed to be ridden by a person. Examples include e-bikes, e-scooters, e-skateboards, e-foils and one-wheelers. Devices that are not ridden by a person, such as remote-controlled toys, are not permitted.
  • EV (fully electric) — road vehicles powered entirely by an electric battery, with no internal combustion engine, and designed to be driven by a person, such as fully electric cars and vans. Vehicles that are not driven by a person are not permitted.
  • PH-EV (plug-in hybrid) — road vehicles combining an electric battery and motor with an internal combustion engine, where the battery can be recharged from an external power source.
  • H-EV (hybrid) — road vehicles combining an electric battery and motor with an internal combustion engine, where the battery is charged by the engine or by regenerative braking rather than from an external power source.
  • Acceptable Items — items meeting the definitions of e-rides, EVs, PH-EVs or H-EVs. These are the only items that may be listed. EV, PH-EV and H-EV are the same labels used on the Post Ad form and the category buttons.
  • Services — work offered in relation to Acceptable Items, including servicing, repairs, installation, inspection, part replacement and maintenance. Examples include EV wall charger installation, EV body repair, pre-purchase inspection, e-bike repair, battery maintenance and software updates.

3. Using the Platform

3.1 What eRideList is — and is not

eRideList is a free classifieds noticeboard. We give sellers, owners and service providers a place to advertise, and buyers and renters a place to find them, within their local area. That is the whole of our role.

  • We are not a party to any sale, rental or service agreement. Every transaction is directly between the Users involved.
  • We do not handle money. We take no payments, hold no deposits or funds in escrow, charge no commission, and offer no payment protection or buyer guarantee scheme.
  • We do not own, inspect, test, store, transport, deliver or service anything advertised on the Platform.
  • We have no control over whether a seller actually has an item, owns it, is entitled to sell it, or will deliver it.

Users may communicate through Platform tools or directly, at their discretion. All communication, transactions and Services — whether arranged on or off the Platform — are at Users' own risk. For guidance on what to watch for, see our common scams and fake trades page.

3.2 What our review actually means

Listings are reviewed by a person before they appear. We aim to complete that review within 24 hours, though it may take longer at busy times. The review checks a listing against our content rules — that it is an acceptable item, is in the right category, is not obviously prohibited, fraudulent or unsafe, and contains the information we require.

Our review is not verification. We do not confirm that a listing is accurate, that an item is in the described condition, that the seller owns it or is entitled to sell it, that it is free of finance or encumbrances, that its battery is sound, that it is roadworthy, or that it is legal to use where you live. A listing appearing on eRideList is not an endorsement, recommendation or warranty by us. You must make your own enquiries before you buy, rent, or engage a Service Provider.

3.3 How listings work

  • Listing is free.
  • An approved listing runs for 30 days. We email you a reminder about seven days before it expires so you can renew it for another 30 days. Renewing does not change your listing, so it does not need another review.
  • If it is not renewed, it expires and comes off the Platform. You can bring it back by editing and resubmitting it, which goes through review again.
  • Editing a listing sends it back for review, because the content has changed.
  • We may decline, remove, pause or ask you to change a listing that breaches these Terms or the law. Where we decline one, we tell you which rule it fell foul of so you can fix it and resubmit.

4. Things you must not do

Users must not:

  • List items that are not acceptable items, or that you may not lawfully sell — including stolen goods, unsafe or recalled products, and non-compliant batteries or chargers.
  • Post false, misleading, fraudulent or scam listings, or list items you do not have.
  • Misrepresent the condition, battery health, ownership, availability, roadworthiness or price of an item, or your qualifications to perform Services.
  • List items that exceed the legal power or speed limits that apply where they are to be used, or advertise a device as legal to ride somewhere it is not.
  • Offer Services you are not licensed or qualified to perform where a licence or qualification is required.
  • Post content that is defamatory, harassing, hateful, obscene, discriminatory, or that infringes someone else's copyright or trade marks.
  • Abuse, threaten, intimidate or harass another User, or use offensive language toward them — in Platform messages, in any email or phone contact that follows, or in person when meeting to inspect, collect, deliver or service an item.
  • Publish another person's personal information without their consent.
  • Send unsolicited commercial messages, or use contact details obtained here for marketing.
  • Scrape, copy or bulk-download listings, or use bots to interact with the Platform.
  • Interfere with the Platform's security, or try to access another User's account.

Treat other Users with respect. Buyers, Owners, Renters and Service Providers are all expected to deal with each other courteously — in messages sent through the Platform, in any contact that follows, and in person while a transaction or service is being arranged or carried out. Disagreeing about a price, an item or a service is normal and fine. Abuse, threats, slurs, discriminatory remarks and offensive language are not, and we do not accept them whichever side of a deal they come from.

Breaches may result in a listing being removed, an account being suspended or closed, and, where appropriate, a report to police or a regulator. You can report a breach using the "Report this listing" link or by emailing support@eridelist.com.au.

5. Your account

5.1 Eligibility

You must be at least 18 years old to hold an account, post a listing, or send messages through the Platform. Anyone may browse the public listings without an account.

By creating an account you confirm you meet this requirement. We may close an account where we reasonably believe the holder is under 18. If an item is bought or ridden by someone under 18, their parent or guardian is responsible for supervising that use and for any licence, permit or safety equipment the law requires.

5.2 Registration

  • Give accurate registration details and keep them current.
  • Keep your password confidential. You are responsible for what happens under your account unless it is used without your fault.
  • One person or business per account; do not share, transfer or sell accounts.
  • You may sign in with an email address and password, or with a Google or Facebook account. Where you use a third-party sign-in, that provider's own terms and privacy policy also apply to what they do with your information.
  • Tell us promptly at support@eridelist.com.au if you think your account has been accessed by someone else.

5.3 Communications

By registering you consent to receiving service messages by email — listing approvals and rejections, expiry reminders, replies to your enquiries, and notices about these Terms. These are part of running your account and cannot be switched off while your account is open. Marketing emails, if we ever send any, are separate and you can unsubscribe from them at any time.

We use reasonable technical and organisational measures to protect your information, but no online service can guarantee absolute security. See our Privacy Policy for how we handle personal information.

5.4 Reviews

Users may leave a review after dealing with another User. Reviews must be honest, based on a genuine dealing, fair, respectful and relevant.

We may remove a review that is abusive, defamatory, off-topic, contains personal information, or was not based on a real dealing. We do not remove a review simply because it is negative or because the person reviewed has asked us to. We do not write reviews ourselves, pay for reviews, or offer any incentive in exchange for a favourable one.

By posting a review you give us a non-exclusive, royalty-free licence to display it on the Platform for as long as it remains posted.

5.5 Suspension and closing your account

You can ask us to close your account at any time by emailing support@eridelist.com.au. There is no self-service delete button — closures are handled by our support team, and we may retain records of your dealings for the period set out in our Privacy Policy. We may suspend or close an account that breaches these Terms or the law, or that puts other Users at risk. Except where the breach is serious, or where we are legally required to act immediately, we will tell you what the problem is and give you a fair chance to fix it first. If we close your account you can ask us to explain why, and you can complain to us about the decision.

6. Transactions and Services

6.1 Listing an item or a service

Owners and Service Providers must ensure that acceptable items are safe, functional and legally compliant, and that Services are performed competently and lawfully. Listings must be accurate, use photographs of the actual item, and disclose faults, damage, repairs, battery condition and range, and anything else a reasonable buyer would want to know.

Private sellers and business sellers

You must correctly identify yourself as a private seller or a business seller. Selling repeatedly for profit makes you a business regardless of what you select.

Business sellers are acting in trade or commerce and carry the full weight of the Australian Consumer Law. If you sell as a business you must:

  • Display your business name and ABN, and any licence your state requires — including a motor dealer licence or LMCT number if you deal in vehicles.
  • Honour the consumer guarantees. You cannot contract out of them: phrases such as "sold as is", "no refunds" or "no returns" do not remove a buyer's statutory rights and may themselves be misleading.
  • Meet any state statutory used-vehicle warranty that applies to your sales.
  • Not engage in misleading or deceptive conduct.

Vehicle listings

You must disclose, where it applies:

  • Whether the vehicle has been written off, is on a written-off vehicle register, or has been repaired after a significant accident.
  • Whether money is owed on it, or any security interest is registered against it.
  • Its true odometer reading and registration status.
  • Any inspection certificate your state requires for a sale. In Queensland a safety certificate is required and its number must appear in the advertisement. In Victoria a roadworthy certificate is required and is valid for 30 days. The ACT and Northern Territory require inspections for older vehicles. New South Wales, South Australia, Western Australia and Tasmania generally do not require an inspection to sell a registered light vehicle privately.

Sellers must also lodge a notice of disposal with their state road authority after a sale, within the period that state requires.

E-bike, e-scooter and battery listings

  • State the motor power in watts and the top speed, accurately. These determine whether a device is legal to use, and in which state.
  • Include the safety approval or certification marking for the device, battery and charger. New South Wales safety and information standards for e-micromobility products have been fully enforced since 1 February 2026, apply to second-hand sales and to products displayed for sale online, and carry substantial penalties. Our rules and battery safety page lists the accepted standards.
  • Include the warning: "Before using this vehicle, check the applicable local laws relating to your intended use of the vehicle on roads and road related areas."
  • Do not list recalled products. Check the national recalls register at productsafety.gov.au/recalls before advertising a used e-ride, battery or charger.

6.2 Arranging a transaction or service

Users arrange sales, rentals and Services directly, including payment, deposits and cancellation. These are agreements between Users; eRideList is not a party to them and does not hold or process any money.

  • Renters must return an item on time and in the same condition, including battery charge level.
  • Users engaging a Service Provider should confirm their qualifications and licences, particularly for battery or software work.
  • All parties are encouraged to record the condition of an item, or the scope of a service, with timestamped photographs or written records at the start and end.

6.3 Inspect before you pay

You are buying from the seller, not from us. Before you hand over money:

  • Inspect the item in person, or arrange an independent inspection.
  • For a vehicle, run a PPSR search — it costs about $2 and tells you whether money is owed on the vehicle. If you buy an encumbered vehicle without searching, a financier may be able to repossess it from you.
  • Check that an e-ride is legal to use where you intend to ride it, and that its battery and charger carry a recognised certification mark.
  • Be wary of anyone who will not meet in person, pressures you to pay quickly, asks for payment by gift card, bank transfer to an unverified account or cryptocurrency, or offers a deal that seems too good. Report them to us — and see our common scams and fake trades page for how each of these actually plays out.

If you choose to pay without inspecting, you accept the risks of doing so. That choice does not, however, take away any right you have against the seller under the Australian Consumer Law or the general law.

6.4 Renter and service-user responsibilities

Renters and Users engaging Services must:

  • Use the item, or engage the service, lawfully and in line with manufacturer or provider guidelines, including safe battery charging practice.
  • Hold any permit or licence required for the use intended, under the law of the state or territory where the item is used.
  • Avoid misuse, neglect, unauthorised operation, overloading batteries or unapproved modification of software or hardware.
  • Report faults, damage or service problems to the Owner or Service Provider promptly.

6.5 Your rights under the Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any right, guarantee or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

Buying from a business

The full consumer guarantees apply — the item must be of acceptable quality, match its description, and be fit for any purpose the seller said it was fit for. If it is not, your remedy is against that seller.

Buying from a private seller

Most consumer guarantees do not apply to a one-off sale between two individuals. There is no acceptable-quality guarantee, no fitness-for-purpose guarantee, and no cooling-off period.

But some guarantees still apply, even privately: the seller must have clear title to the item, must be able to give you undisturbed possession of it, and must disclose any undisclosed security over it. Fraud and misrepresentation remain unlawful in any sale.

6.6 Disputes and reporting a problem

Users are responsible for resolving disputes between themselves — damage, non-payment, cancellation, or the quality of an item or a Service. eRideList is not a party to those dealings and cannot decide them or award a remedy.

We do, however, act on reports. Every listing has a "Report this listing" link, and you can always email support@eridelist.com.au.

  • We aim to remove or restrict access to listings for unsafe or recalled products within 2 business days of becoming aware of them.
  • We aim to respond to a written complaint about defamatory or otherwise unlawful user content, and to take reasonable access-prevention steps where warranted, within 7 days.
  • To help us act, tell us which listing, what is wrong with it, and how to reach you.

Keep your evidence — photographs, messages, receipts and records. If a dispute cannot be resolved directly, you can take it to your state or territory consumer affairs or fair trading body, to the relevant civil and administrative tribunal, or to a court. Conduct that may breach the Australian Consumer Law can be reported to the ACCC at accc.gov.au. Scams can be reported to Scamwatch.

7. Privacy

We handle personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth). Our Privacy Policy and Cookie Policy explain what we collect, why, who we share it with and how to access or correct it.

Account and listing data is stored in Australia (Supabase, AWS ap-southeast-2 Sydney region). Transactional email is sent through United States (Resend, transactional email delivery).

If you are not satisfied with how we have handled your personal information, tell us first at support@eridelist.com.au. You can also complain to the Office of the Australian Information Commissioner at oaic.gov.au.

8. Intellectual property and your content

We own or licence the Platform itself — its name, logo, design, text and software. You must not copy, reproduce or reuse it without our consent.

You keep ownership of everything you post. By posting it you give us a non-exclusive, royalty-free licence to host, store, reproduce, adapt for formatting and display your content on the Platform and in promotion of the Platform, for as long as your content remains on the Platform. That licence ends when your content is removed, except for copies already made in backups or where we must keep a record by law.

You confirm you have the right to grant that licence — for example, that you took the photographs or have permission to use them. If you believe content on the Platform infringes your copyright or trade mark, email support@eridelist.com.au with details of the listing and your claim.

9. Liability and indemnity

The Platform is provided free of charge and on an "as is" basis. We do not promise that it will be uninterrupted or error-free, and we are not responsible for the conduct of any User, the accuracy of any listing, the condition, safety or legality of any item, the quality of any Service, or the outcome of any transaction arranged through the Platform.

Dealings between Users are their own. Every sale, rental and Service arranged through the Platform is an agreement between the Users involved, not with us. Those Users carry the responsibility and the risk for it — payment, the condition, safety, legality and description of an item, the standard of any Service, and any loss, damage, theft or injury arising from it. Meeting another User, allowing an inspection or test ride, handing over an item or money, and riding, driving or using anything advertised here are all done at your own risk.

Subject always to the paragraph below, you release us from any claim you may have against us arising out of a dispute between you and another User, and you agree to pursue that dispute with them directly.

Nothing in these Terms excludes, restricts or modifies any liability that cannot be excluded, restricted or modified under the Australian Consumer Law or any other law. This includes liability for death or personal injury caused by our negligence, and the consumer guarantees that apply to the services we supply.

Where the law permits us to limit our liability for a service we supply, our liability is limited to resupplying that service or paying the cost of having it resupplied. To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of profit or opportunity.

Indemnity. If a third party brings a claim against us because your content was unlawful, or because you breached these Terms or the law, you agree to cover the reasonable costs and losses we incur in dealing with that claim, to the extent it results from your act or omission. This does not apply to the extent the claim was caused by our own negligence or breach.

10. General

  • Governing law. These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that state — which means you may still bring proceedings in the courts or tribunal of the state or territory where you live.
  • Entire agreement. These Terms, together with our Privacy Policy and Cookie Policy, are the whole agreement between you and us about the Platform.
  • Severability. If part of these Terms is found unenforceable, that part is severed and the rest continues to apply.
  • No waiver. If we do not enforce a right straight away, that does not mean we have given it up.
  • Events outside our control. We are not liable for delay or failure caused by something genuinely beyond our reasonable control, such as a natural disaster or an outage at a service provider we depend on.
  • Assignment. You may not transfer your account or your rights under these Terms. We may transfer ours if the Platform is sold, on notice to you, provided your rights are not reduced.

Questions, complaints and reports go to support@eridelist.com.au, or through our contact form. We aim to acknowledge every message within 7 days. We handle everything by email and do not operate a phone line.
